They all sell to W E Gainey half interest in a tract conveyed by Elias Gainey to W E Gainey and J A Gainey by deed dated 3 Sept 1883. Part paid now, part paid later. 5. Property, 29 Dec 1890, Cumberland County, North Carolina, United States. 939 126 acres of land, which was the eastern portion of a 200 acre tract owned by W. E. & J. A. Gainey, deeded from Elias Gainey in Deed book Z No 3 page 598, and purchased and mortgaged by W. J. D. Haywood (recorded in Book G No 4 p530), was sold to Noel Gainey to repay the mortgage. Noel then deeded 100 acres to W. B. Draughan and kept the remaining 26 acres.

13. Court: Cedar Creek and Flea Hill Canal Company, 30 Sep 1908, Cumberland County, North Carolina, United States. 980 A group of land owners (T. J. Haywood, Noel Gainey, W. O. Haywood and wife Lella, William Haywood, and ohers) petition the court to form a corporation and dig ditches and canals to drain an area of land that they together own. All members will be assessed a share of the cost. The petition names defendants, presumably they are people who have not agreed to this but will be assessed a cost since the effort will increase the value of their land.

The court orders a group of others (including W. H. Downing) to investigate and report back, including laying out the canal route. They do, with the lands mentioned including Erle Downing, although he is not named as a defendant. The court assesses cost and creates a new corporation to perform the work and maintain the canal in the future, with each member holding stock in the corporation. The corporation is "Cedar Creek and Flea Hill Canal Company". Petition dated 30 Sep 1908, completed by 20 Feb 1909.
